Third Ballot Initiative Fails
The ballot initiative to amend Article XI, Section 1 of Third’s CC&Rs, which would have allowed the board flexibility to control the impact of soaring property insurance premiums, did not pass.
The outcome of the ballot therefore does not change the responsibility of the Third board, which remains obligated to bind property insurance coverage for full replacement value. Without the “yes” vote Third needed, members can expect a significant assessment increase of $93 per month.
Of 5,780 ballots mailed to members eligible to vote, 3,068 were cast successfully; 2,701 members voted “yes,” and 367 members voted “no.” In order for an amendment to the CC&Rs to pass, 67% of members must vote in favor. That means 3,873 yes votes were required to pass the amendment—Third fell 1,172 votes short of passing the amendment. The percentage of non-voting members, or apathy vote, was 47%.
The Third board is closely examining all possible alternatives, which may include seeking a CC&R amendment via judicial appeal. However, even if successful, this cannot be achieved prior to the deadline to bind property insurance coverage for 2022.
The next Third Laguna Hills Mutual open board meeting occurs July 20 at 9:30 a.m. in the Community Center board room. Third members may participate in person or via Zoom and/or watch via Granicus (lagunawoodsvillage.com/meetings) or on Village Television (TV6). Members also may submit comments by calling 949-268-2020 one half hour before the meeting begins and throughout the meeting. Members may speak via Zoom during the open forum by notifying the moderator via the on-screen Raise Hand button.
