Residents are saying:
United Non-Smoking Building Designation
United Non-Smoking Building Designation Many residents of United Mutual have expressed to the Board their interest in maintaining a healthy and safe environment in the buildings where they live. Of particular concern is second-hand smoke. Therefore, they have asked that the United Board designate the buildings in which their Manors are located as “smoke-free”, to reduce their potential exposure to second-hand smoke. On September 30, 2011, the United Board adopted a policy to give members an avenue to designate their residential building as non-smoking only if all current residents of that building support the change. United considered that, in addition to addressing health concerns related to second-hand smoke, non-smoking buildings will have a reduced risk of fires related to accidents stemming from the use of smoking tobacco and other substances, and reduced maintenance and repair costs for building components due to wear and tear caused by smoke. According to the policy, buildings will be designated as non-smoking on a permanent basis. Designation of a building as non-smoking may occur upon the collective and unanimous written consent of all current Members of that building, subject to a valid Occupancy Agreement. Any Member may petition United to designate a building in which his/her manor is located by completing the United “Petition for Designation as a Smoke-Free Building” form available through the Village website, www.lagunawoodsvillage.com. The petition must signed by all applicable members in front of a notary public or it will be deemed incomplete. When a completed petition is submitted to and verified as complete by United, the Board will schedule a hearing with the applicable Members to confirm that none of them oppose the designation of their building as non-smoking. The hearing will be held in an open session meeting of the Board within sixty (60) days of the verification of the petition. If any applicable Member residing in the subject building opposes the petition at the hearing, then the Board will deny the petition. A listing of non-smoking buildings in United will be maintained by the Community Services department on behalf of United and will be available on the Village website. Buildings designated as non-smoking will have signs posted prominently on the building that say “No Smoking Anywhere in Building”. Persons residing in that building will be required to remove all tobacco products and other substances that generate smoke from their Manors and the Building. The designation of the building as non-smoking will be permanent and recorded as part of the manor’s Occupancy Agreement. According to the policy, “all Applicable Members, all Members subject to a future Occupancy Agreement to a Manor in the Building and all current and future Qualifying Residents, Co-occupants and Lessees residing in a Manor in the Building, and the family members, guests and invitees of each of them, shall be prohibited from smoking anywhere in the Building as of the Conversion Date.” Smoking within a Building receiving a designation will be considered a violation of the Occupancy Agreement. If an alleged violation is reported to United, United will investigate the allegation and, as appropriate, call the offending member to a hearing before the Board in accordance with the disciplinary proceeding requirements under United’s Bylaws and applicable state statute. |
