The Federal Communications Commission provides that any condominium or co-op owner or renter may install a satellite dish having a diameter of less than 39.37 inches wholly within their exclusive use area (or like counterpart in a co-op). An exclusive use area is defined by the FCC as “an area of the property that only you, and persons you permit, may enter and use to the exclusion of other residents”. Per the Davis-Stirling Act, “any shutters, awnings, window boxes, doorsteps, stoops, porches, balconies, patios, exterior doors, doorframes and hardware incident thereto, screens and windows or other fixtures designed to serve a single separate interest, but located outside the boundaries of the separate interest, are exclusive use common areas allocated exclusively to that separate interest”.

If a Member would like to install a satellite dish on common area, such as on a building roof or fascia, they must comply with their Mutual’s Architectural Review procedure. If an Alteration Standard exists that applies to their manor for the installation of a satellite dish, a Standard Alteration Permit must be submitted, with the required plans and paperwork, and approved before the applicant can install a satellite dish. If there is no Alteration Standard, the Member may submit a Request for Variance, and their Mutual Board will rule whether to permit the satellite dish installation.
